Terms of service

Terms of Service

Welcome to Aroos Jewellers. These Terms of Service explain the terms that apply when you access our website, browse our products, place an order, or otherwise use our online services through aroosjewellers.com.

By accessing or using our website, you agree to these Terms of Service and any policies referenced within them. Please read these terms carefully before making a purchase.

These Terms operate alongside your rights under applicable Australian laws, including the Australian Consumer Law (ACL).

1. About Aroos Jewellers

Aroos Jewellers operates an online jewellery store offering jewellery and related products to customers in Australia.

Our business contact details are provided at the end of these Terms.

2. Using Our Website

You agree to use our website only for lawful purposes and in a manner that does not:

  • Violate any applicable law or regulation.
  • Infringe the rights of Aroos Jewellers or another person.
  • Interfere with the operation or security of our website.
  • Attempt to gain unauthorised access to our systems or accounts.
  • Introduce malicious software, code, or other harmful material.
  • Use our website for fraudulent, misleading, or deceptive purposes.

We reserve the right to restrict or suspend access to our website where reasonably necessary to protect our business, customers, website, or legal interests.

3. Eligibility

You must have the legal capacity to enter into a contract to place an order through our website.

If you are under the age required to enter into a contract in your jurisdiction, you should only use our website and place orders with the involvement and consent of a parent or legal guardian.

4. Products and Product Information

We make reasonable efforts to ensure that product names, descriptions, images, specifications, measurements, colours, prices, and other information displayed on our website are accurate and up to date.

However, photographs and colours may appear differently depending on your device, screen settings, lighting, and other factors.

Product availability may change without notice. We may update, modify, replace, or discontinue products from time to time.

Where information on our website contains an inadvertent error, we reserve the right to correct the information. If an error materially affects an order you have placed, we will contact you where reasonably possible to discuss the available options.

5. Pricing

All prices displayed on our website are in Australian dollars (AUD) unless otherwise stated.

Prices may change from time to time. Any price change will not affect an order that has already been accepted, except where a correction is required because of an obvious pricing or listing error.

Where applicable, prices include Australian Goods and Services Tax (GST).

6. Placing an Order

When you submit an order through our website, you are making an offer to purchase the selected products in accordance with these Terms.

After submitting your order, you may receive an order confirmation email acknowledging that we have received your request. An order confirmation does not necessarily mean that your order has been accepted.

We may accept or decline an order before dispatch for reasonable reasons, including product availability, suspected fraud, payment issues, pricing errors, or information that cannot reasonably be verified.

If we are unable to fulfil an order after payment has been received, we will arrange an appropriate refund for amounts paid for products that we cannot supply, subject to any applicable legal rights.

7. Payment

Payment must be successfully received before an order is processed for dispatch unless another payment arrangement has been expressly agreed with you.

We may accept payment methods displayed at checkout, which may include major credit and debit cards and other payment methods made available through our payment providers.

Payment information is processed through third-party payment providers. Aroos Jewellers does not intentionally retain complete payment card details on its own systems where those details are processed by the relevant payment provider.

8. Order Information

You are responsible for providing accurate and complete information when placing an order, including your name, delivery address, email address, telephone number, and other information required to process the purchase.

Please review your details carefully before completing checkout. If you identify an error after placing an order, contact us as soon as possible.

We will make reasonable efforts to assist with changes before an order is processed or dispatched, but we cannot guarantee that changes will be possible after fulfilment has commenced.

9. Shipping and Delivery

We currently ship orders within Australia.

Orders are generally processed within 1–2 business days, followed by the applicable delivery timeframe shown in our Shipping Policy.

Delivery estimates are provided as a guide and may vary depending on the destination, delivery network, public holidays, weather, seasonal volumes, or other circumstances outside our reasonable control.

For complete information about delivery, tracking, delivery delays, and shipping costs, please refer to our Shipping Policy.

10. Returns, Refunds and Exchanges

Our returns and refund procedures are explained in our Refund & Returns Policy.

Our voluntary returns policy does not limit any rights or remedies you may have under the Australian Consumer Law.

11. Australian Consumer Law

Our products come with automatic consumer guarantees under the Australian Consumer Law where those guarantees apply.

Nothing in these Terms is intended to exclude, restrict, or modify a consumer guarantee, statutory right, or remedy that cannot legally be excluded, restricted, or modified.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Consumer guarantees may apply for a reasonable period depending on the type, nature, price, and other circumstances of the product. These rights are separate from any voluntary warranty or change-of-mind return policy.

12. Jewellery Care and Product Use

Jewellery should be handled and cared for appropriately. Depending on the product and materials used, exposure to chemicals, cosmetics, perfumes, moisture, excessive friction, heat, or improper storage may affect the appearance or condition of jewellery.

Any care instructions supplied with a product should be followed.

Nothing in this section excludes or limits any rights you may have under Australian Consumer Law where a product does not meet an applicable consumer guarantee.

13. Intellectual Property

Unless otherwise stated, the content appearing on our website, including text, product descriptions, photographs, graphics, logos, designs, page layouts, and other materials, is owned by or licensed to Aroos Jewellers or its relevant rights holders.

You may access and use the website for personal and lawful shopping purposes. You must not reproduce, copy, modify, distribute, republish, sell, or commercially exploit our website content without prior written permission, except where permitted by law.

14. Third-Party Services and Links

Our website may use third-party services, payment providers, shipping providers, analytics services, applications, or links to third-party websites.

Third-party services may have their own terms, conditions, and privacy policies. Aroos Jewellers is not responsible for third-party websites or services to the extent permitted by law.

15. Website Availability and Security

We aim to keep our website available, functional, and secure, but we do not guarantee that the website will always be uninterrupted, error-free, or available at all times.

Website availability may occasionally be affected by maintenance, technical problems, telecommunications issues, hosting problems, security incidents, or circumstances outside our reasonable control.

16. Limitation of Liability

To the maximum extent permitted by law, Aroos Jewellers is not responsible for loss or damage arising from your use of our website where that loss or damage is not caused by a breach of our legal obligations.

However, nothing in these Terms excludes, restricts, or limits liability where doing so would be unlawful, including liability that cannot lawfully be excluded under the Australian Consumer Law.

Where a consumer guarantee applies, you retain the rights and remedies provided by that guarantee. Australian law may also provide rights to compensation for reasonably foreseeable loss or damage resulting from a failure to meet a consumer guarantee.

17. Events Outside Our Reasonable Control

We will not be responsible for delay or failure to perform an obligation where the delay or failure is caused by circumstances outside our reasonable control, such as natural disasters, severe weather, transport disruptions, industrial action, telecommunications failures, supplier disruptions, government actions, or other comparable events.

This provision does not affect any rights or remedies that cannot legally be excluded under Australian law.

18. Privacy

Your use of our website may involve the collection and handling of personal information.

Please refer to our Privacy Policy for information about how we collect, use, store, and protect personal information.

19. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to our business, website, products, services, or legal requirements.

The current version will be published on this page with the applicable effective date. Changes will generally apply from the date they are published and will not retrospectively remove rights that have already arisen.

20. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be read down or removed to the extent necessary, while the remaining provisions will continue to operate to the extent permitted by law.

21. Governing Law

These Terms of Service are governed by the laws applicable in South Australia and Australia.

You agree that disputes relating to these Terms or your purchase will be subject to the applicable courts and laws of South Australia and Australia, subject to any mandatory rights or protections available to you under Australian law.
